Terms and conditions for the raffle

CONDITIONS

 

I. General


Each participant acknowledges, irrevocably, by registering for this raffle, the terms and conditions explicitly, set forth herewith and also agrees that the German version of these terms and conditions is overruling, should there be any discrepancies.


II. Subject of raffle

 

Included in the raffle is Portion 20 of Farm Buffelsbosch Nr. 742, which is close to St. Francis and covers an area of 16,42 ha. Available valuations indicate a total amount for these items of 820,000 Euros.

 

III. Trustee

1. Execution and operation of the raffle and oversight of proper transfer documents of title deeds and other required documentation, based on the final result of the raffle, will be carried out or supervised by Mrs. Dr.Christa Kohl-Rupp, attorney at law and a member of the Fiduciary Audit committee of the bar association of Styria, Austria, with offices in 8010 Graz Schönaugasse 44.

2. With payments of the tickets the participant irrevocably authorizes the trustee to use the trust money for ticket purchases, as soon as it is obvious that the raffle will actually take place. The funds will remain in the trust account until tickets are actually being purchased.

After ticket purchases, the following will apply to this trust account: once all issued tickets have been sold and after the draw has been carried out, the trustee Mrs. Dr. Christa Kohl-Rupp will supervise the proper execution of the property documents by appointing a South African attorney to perform the conveyance of the respective properties and after payment of all taxes, rates, fees and other cost will pay the remaining balance to the property owner.

Should not all of the 10.999 tickets been sold by the planned day of the draw, 31.01.2010, the property owner has the opportunity to go ahead with the raffle regardless, however, this procedure has to be announced on the homepage well in time that a minimum of 14 days lead time will have to remain until the execution of the draw; should the owner decide not to proceed with the draw in case the number of tickets sold is inadequate, the ticket price paid will be refunded to the account the participant indicated, or by money order mailed to the address given, whereby the actual cost for this refund , probably max. 16,-- Euros, will have to be deducted.


IV. Execution

1. Participants may be legal or natural persons. Natural persons must have completed, at the day of the draw, their 18th birthday and must have full legal capacity.

2. Participation is only possible through the mask published on the respective internet website, or through a flyer issued by the owner and operator of the raffle.

3. Each participant is solely responsible and liable for the information issued.

4. A registration number will be issued upon every registration. This registration number will, in turn, entitle the participant to pay for tickets up to a maximum of the issued tickets, to enable the trustee to purchase the respective ticket ad initio. The registration number will, in case of a draw, enable Mrs. Dr. Christa Kohl-Rupp to identify the winner.

5. The permission to participate in an eventual draw will, for the payments of the first 10.999 tickets, become effective only with receipt of payment in the trust account; ticket numbers will be allocated within 2 weeks before the raffle and thereafter mailed to the participants.

6. Everyone can use any computer to participate.

7. One participant may register multiple times.

8. Funds received of less than EUR 99,--, as well as overhangs from ticket sales will be donated to SOS Kinderdorf-Charity.

9. The draw for the raffle will be public.

10. Should all 10.999 tickets be sold before the envisaged date, the draw will be at an earlier date. However, 14 days have to remain between the sale of the last ticket and the date of the draw. The date of the draw as well and the time schedule will have to be published on the home page. All not correct payments will be donated to SOS Kinderdorf-Charity.

11. Incoming payment to the trust account will be checked by the trustee and cross-checked with the registration numbers.

12. The draw will be carried out, as follows: four transparent glass containers will be filled for the draw in the following manner: In 3 of these containers smaller containers, that are nontransparent containing the numbers 0 to 9 will be added, in the fourth glass container small nontransparent containers containing the numbers 0 to 10 will be added. The draw starts with the first digit. The draw will be attended by Dr. Christa Kohl-Rupp and the owner of the properties.

Upon the successful draw and the emerging result, the document with the registration numbers will reveal the data of the winner. The winner will be published together with the winning ticket number.

13. The winner will be notified by the trustee based on the data in the list of registration numbers

14. Hence the winner or their heir can claim his/her win within 20 days after the day succeeding the draw. Should the trustee be unable to notify the winner and the winner has not claimed his win within 20 days by contacting the trustee, there will be a new draw within 5 working days. Within 4 weeks after contact between the winner and the trustee a deed of sale will be signed by the owner that will enable to register the winner as new owner with the Deeds Office in South Africa.

 

Furthermore the winner will receive 2 return airline tickets to South Africa (Economy Class) and 5 days overnight
( bed and breakfast ) at the site.


15. The transfer of all items affected by the draw will have to be done not more 6 weeks after transfer documents have been signed, without any warranty whatsoever, as far as size, condition, revenues, position are concerned. All wins are handed over as is where is! The property owner is obliged to sign the deed of sale without delay. The properties and other affected items will be free of taxes, fees, liens, encumbrances and levies, whatsoever.

16. All fees, cost or other payments that are affected by the raffle will be covered by the owner. (e.g. transfer charges, VAT, cost of registration, lawyer’s fees).

17. Registration details are being handled by using highest technology available to protect the user to the highest degree. Users are also protected by Austria’s highly restrictive Banking Secrecy Law. All data will be deleted by the trustee after the new owner is registered on the properties.

18. Austrian Law is applicable. IPRG is not included. Place of venue is generally Graz/Austria.

19. This particular raffle is a onetime event of the property owner, not a continuing commercial operation, and therefore is not in conflict with the Government’s lottery monopoly.

20. Total tickets offered are 10.999 ; price per ticket EUR 99,--.
