Terms & Conditions


I. Preface
Every participant in the underlying lottery accepts fully and irrevocably the content of the following terms and conditions with completion of the registration. 
All mortgages on the object at the time will be wiped off according to the outcome of the lottery. 
II. Subject to the lottery
Subject to the lottery is the object „The Cottages at Madeira Beach,“ consisting out of seven vacation homes land register block 11, lots 19 and 20 Tr 58320, Mitchell’s Beach Revised, Madeira Beach, Fl. 33708; This complex is so situated that it can be rented out throughout the whole year. The flight to Madeira Beach in order to constitute the land register entry according to the outcome of the lottery will also be paid for the winner. Furthermore, the renting business and the costumer list will be raffled off in combination with the object itself. 
III. Trustee 
1. The organization and conduction of the lottery as well as the recordation of the final result will be controlled by:

2. With payment of the lot price the participants irrevocably put the trustee in charge to buy lots with the transferred money if and when the conduction of the lottery is certain.

A disposal of the account only happens as follows: After all the lots are sold and the lottery is finished, the contract for the transfer of deeds will be constituted and the recordation in the land register will be initiated as the result of the raffle determines. 
After all taxes, fees and other costs are covered the remaining amount of money will be paid to the former owner of the object. 
In case there have been registrations and nonetheless the required amount of 14.999 lots has not been sold until the 31.12.2009 the owner of the object has the option to either raffle the object off anyway, whereby the date of the lottery has to be displayed on the homepage at least 14 days before the day of the drawing, or to call the lottery off. 
In case the owner calls the lottery off the monies will be paid back to the bank accounts of the remitters or send back by money order to the addresses stated, whereby the actual expenses of maximal EUR 18.00 per lot will be deducted. 
IV. Conduction 
1. Both natural and legal persons are eligible to take part in the lottery. Natural persons have to be of age and full legal capacity at the time the lottery takes place. 
2. Participation is possible only via the user template provided on the internet. 
3. All participants are responsible for the truthfulness of the data they used in the registration form. 
4. At registration a registration number is assigned which entitles the participant to by lots. One ore more lots will be ordered through the user template. For each ordered lot the participant gets a registration number. Using the registration number trustee Dr. Kohl-Rupp is able to determine the winner in case the drawing takes place. 
5. The right to take part in the lottery arises with the arrival of the lot price, or prices, in the trustee account. Only the first 14.999 payments have a right to take part in the lottery. After the monies have been used to buy the lots, the lot numbers will be sent to the participants two weeks before the drawing takes place. 
The participants may use any computer to make their registration.
6. The same participant may register several times. 
7. Payments under € 99.00 as well as payments of more than the lot price or a multiple of the same will be donated to the Austrian Child Cancer Aid. 
8. The drawing is going to take place publicly. 
9. In case the total amount of lots is sold prior to the stated date of the drawing the lottery will take place earlier.
Between the sale of the last lot and the date of the raffle has to be a term of at least 14 days.
Furthermore, the date has to be announced on the homepage.
All incorrect payments are going to be donated to the Austrian Child Cancer Aid. 
10. The incoming payments in the stated trustee account will be personally monitored by the trustee and checked with the registration numbers.
11. The drawing will happen as follows: There will be 3 transparent vessels in which there will be 10 non-transparent little boxes. In each of those boxes is one piece of paper with a number from 0 – 9 written on them. In the fourth vessel will be 14 boxes with the numbers 0 – 14 written on them. 
All four vessels will be shuffled and then one box from each vessel, starting with the units digit will be drawn. The four drawings together will show the winning number. 
At the drawing the trustee, Dr. Christa Kohl-Rupp, as well as the owner will be present. 
After the drawing the data of the winner will be determined through the list of registration numbers and the corresponding registration form.
The winner as well as the winning lot number will be announced publicly. 
12. The winner will be contacted by the trustee according to the data stated in the registration form. 
13. The winner or his/her legal successor has to accept the win within a term of 20 days starting on the following day of the drawing of lots. If the winner doesn’t accept the win within the term mentioned above there will be a new drawing of lots within 3 business days. Within 4 weeks after the contacting of the winner by the trustee there will be set up a deed of transfer between the vendor and vendee based on which the entry in the land register will be constituted.
14. The handover of the property will take place latest 4 weeks after signature of the deed of transfer. A guarantee for a certain condition of the property, a certain productivity, a certain dimension, location or quality will not be given. The owner of the property is held to sign the deed of transfer without delay.
15. The owner of the object of the raffle will bear all fees, costs and other expenses arising from the raffle and the transfer of property. (For example: real estate transfer tax, land register entry fee, execution of the contract and the like)
16. The registration process is conducted in a way that a monitoring of the data by unauthorized persons is not possible. The Austrian bank secret also applies.
All the data of the participants will be deleted after the transfer of deeds is completed.
17. Austrian law excluding IPRG applies. Place of jurisdiction is Graz. No recourse to legal action is permitted.
18. The underlying case is a one-time raffle of the owner, therefore not a consecutive activity directed towards a realization of profits wherefore it does not infringe the exclusive right of the state of Austria to execute lotteries.
19. The total amount of lots is 14,999 at a price of € 99.00 a piece. 

I. Preface

 

Each participant acknowledges, irrevocably, by registering for this raffle, the terms and conditions explicitly, set forth herewith and also agrees that the German version of these terms and conditions is overruling, should there be any discrepancies.

 

All mortgages on the object at the time will be wiped off according to the outcome of the lottery. 

 

II. Subject to the lottery

 

Subject to the lottery is the object “Case Carina”, which incorporates a restaurant, training
facilities, a private apartment and a subsidiary building.
This complex rests in Piemont and carries the land register number 1673 and the parcel
number 122, Sub. 1 and 2, sheet 6.

 

III. Trustee 


1. The procedure of the draw, control over its proceedings and registering the new owner with appropriate institutions according to the relevant conditions of the draw is being dealt with by:

In case there have been registrations and nonetheless the required amount of 41.999 lots has not been sold until the  30th of June 2011 the owner of the object has the option to either raffle the object off anyway, whereby the date of the lottery has to be displayed on the homepage at least 14 days before the day of the drawing, or to call the lottery off. 

In case the owner calls the lottery off the monies will be paid back to the bank accounts of the remitters or send back by money order to the addresses stated, whereby the actual expenses of maximal EUR 9.00 per lot will be deducted.
